Federal judge orders trial for Democrat Rep. McIver over ICE facility incident

 November 16, 2025

A federal judge just dropped the gavel on New Jersey Democrat Rep. LaMonica McIver, ruling she must face trial for allegedly assaulting federal law enforcement officers.

Breitbart reported that U.S. District Judge Jamel Semper denied McIver’s motion to dismiss two of the three charges against her, sending the case straight to trial over an incident at an immigration detention center in Newark.

This saga kicked off back in May when McIver, alongside fellow New Jersey Democrats Rep. Bonnie Watson Coleman and Rep. Robert Menendez, plus Newark Mayor Ras Baraka, showed up at Delaney Hall ICE detention facility for what they claimed was federal oversight.

Judge Rejects McIver’s Dismissal Plea

Things quickly spiraled, with allegations of trespassing and, in McIver’s case, assaulting, resisting, and impeding federal officers during the heated encounter.

While Mayor Baraka faced a trespassing charge that was later dropped by the Department of Homeland Security, McIver wasn’t so lucky, getting slapped with an indictment on three serious counts.

Two of those counts carry a potential eight-year prison sentence each, while the third could mean up to one year behind bars, according to Acting U.S. Attorney for the District of New Jersey Alina Habba.

Department of Homeland Security Secretary Kristi Noem didn’t mince words, pointing out that she had invited officials to tour the facility a month before this fiasco unfolded, rendering the Democrats’ dramatic entrance entirely unnecessary.

After a thorough investigation by Homeland Security Investigations, including a review of video evidence, the U.S. Attorney’s office decided to press charges against McIver for her actions that day.

Secretary Noem stated, “After a thorough review of the video footage of Delaney Hall and a full investigation from HSI, the U.S. Attorney for the District of New Jersey had made the determination to charge Congresswoman LaMonica McIver for assaulting, resisting, and impeding law enforcement officers.”

No One Above the Law

She continued, “No one is above the law. If any person, regardless of political party, influence or status, assaults a law enforcement officer as we witnessed Congresswoman McIver do, you will be prosecuted to the fullest extent of the law.” Well, that’s a refreshing reminder in an era where some seem to think rules are just suggestions.

Judge Semper also brushed aside McIver’s claims of political retribution and her argument that, as an elected official, she should somehow be immune from prosecution.

Sorry, Rep. McIver, but wearing a congressional pin doesn’t come with a get-out-of-jail-free card, and it’s heartening to see the judiciary hold that line.

Both Noem and Habba underscored a principle conservatives have long championed: accountability applies to everyone, no matter how loudly one might protest about progressive causes at an ICE facility.

While some on the left may cry foul over this as another example of supposed overreach, the fact remains that law enforcement officers deserve respect, not resistance, when doing their tough jobs.
