Illegal immigrant who attacked jogger with a hammer was released by Biden administration despite criminal record

 November 18, 2025

A shocking assault in a peaceful Texas park has exposed troubling gaps in immigration enforcement, as an illegal immigrant stands accused of a brutal hammer attack on a female jogger.

In Plano’s Bob Woodruff Park, on November 13, a 17-year-old from Mexico, Sergio Noe de Nova Duarte, allegedly struck a woman with a hammer in a vicious and unprovoked act.

The New York Post reported that Duarte attempted to restrain the victim with duct tape after the initial assault, but her fierce resistance forced him to flee the scene.

The jogger, whose identity remains private, was rushed to a local hospital for treatment, though the full extent of her injuries has not been disclosed. Duarte was swiftly apprehended by law enforcement and now faces serious charges of aggravated kidnapping and causing bodily injury.

Adding a layer of complexity, Immigration and Customs Enforcement (ICE) officials have issued a federal detainer request for Duarte, signaling their intent to take custody following local proceedings.

Immigration Status Raises Policy Questions

Records show that Duarte has been in the United States without authorization since overstaying a tourist visa back in 2016.

More concerning, this is not his first brush with the law—earlier in 2024, he was arrested for burglary and larceny, charges that highlight a pattern of troubling behavior.

Despite this criminal history, federal officials confirm that Duarte was released after his 2024 arrest under the current administration’s oversight, a decision now under intense scrutiny.

Homeland Security Assistant Secretary Tricia McLaughlin didn’t mince words, stating, “This criminal illegal alien should have never been loose in our communities to attack this woman jogging in a park with a hammer.”

Her frustration is palpable, and it’s hard to disagree when a violent crime follows such a questionable release—why wasn’t more done to prevent this tragedy?

McLaughlin further criticized the administration’s actions, noting, “Following this illegal alien’s arrest in 2024, the Biden administration released this criminal illegal alien back into our communities.”

Calls for Stronger Enforcement Grow

That decision, she argues, left communities vulnerable, and it’s a stark reminder of the risks when enforcement policies prioritize leniency over public safety.

While compassion for individual circumstances is important, the balance must tilt toward protecting law-abiding citizens from preventable harm, especially in cases with documented criminal records.

This incident in Plano isn’t just a local crime story—it’s a flashpoint for a broader debate on how immigration laws are enforced, and whether current policies are leaving American communities exposed to unnecessary dangers.
