Kim Zolciak's 15-year-old son arrested on aggravated sodomy, sexual battery charges in Georgia

 August 21, 2026

Kroy Biermann Jr., the teenage son of "Real Housewives" star Kim Zolciak, faces two felony-level charges after Alpharetta police arrested him over an alleged sexual assault inside a gym changing room, charges both his mother and his attorney deny in forceful terms.

Alpharetta police took the 15-year-old, known as "KJ," into custody Monday on charges of aggravated sodomy and aggravated sexual battery. Fulton County, Georgia, juvenile court documents outline the allegations: a female classmate told police that KJ lured her into a changing room at a Life Time Fitness location, then grabbed her, kissed her, forced oral sex, and digitally penetrated her while she repeatedly told him "no."

KJ is being held without bond. A hearing is set for September 1.

Court documents describe the alleged assault on April 23

The juvenile court papers, obtained by Page Six, lay out the accuser's account in detail. She told police she had been walking with KJ, described in the filings as a football player, when he began flirting and making jokes. He then stepped into one of the changing rooms and called out to her: "Hey, look at this."

Once inside, the accuser said, KJ began grabbing parts of her body and kissing her. She told investigators she said "no" repeatedly as he touched her. She accused him of forcing oral sex and digitally penetrating her.

"She finally managed to get away from him, and he pulled up his pants and left," the court documents state.

One day later, on April 24, the accuser went to a hospital for a sexual assault examination. That exam found no male DNA in her mouth or vagina at the time it was conducted.

The court filings also note that KJ did not scan into the gym on the day of the alleged incident, but that he was visible in the facility's security camera footage. The documents do not explain the discrepancy.

Zolciak and KJ's attorney both call the allegations false

Kim Zolciak, best known for her role on Bravo's "Real Housewives of Atlanta," issued a statement Friday pushing back hard on the charges. She called the accusations against her son reckless.

"The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged."

That statement was quoted in part. It is unclear whether the full text addressed additional details of the case.

KJ's attorney, Jason Sheffield, went further. Sheffield declared his client not just legally presumed innocent but actually innocent, and pledged to take that case directly to prosecutors.

"He is not only presumed innocent, but is in fact, innocent. I will work tirelessly to demonstrate to the District Attorney's office the mean spirited nature of these false allegations and to bring a close to this matter as quickly as possible."

Sheffield's statement was also quoted in part. Neither the attorney nor Zolciak addressed the security camera footage or the hospital examination referenced in the court filings.

Serious charges carry serious weight in Georgia juvenile court

Under Georgia law, aggravated sodomy and aggravated sexual battery are among the most severe offenses on the books. Even in the juvenile system, charges of this magnitude can carry significant consequences, including the possibility that a case could be transferred to adult court depending on the circumstances and the prosecution's assessment.

The case is being handled through Fulton County's juvenile court system, and Sheffield's statement indicates he intends to make his case to the district attorney's office, suggesting formal prosecutorial review is either underway or expected. The September 1 hearing will be the next public milestone in the proceedings.

The arrest adds to a growing list of high-profile legal cases involving public figures and their families. In recent months, Detroit Lions cornerback Terrion Arnold faced eight felony counts in a Florida kidnapping and robbery scheme, a reminder that fame and athletic talent offer no shield from the justice system.

KJ's arrest also comes during a period when celebrity legal troubles have drawn sustained public attention. Former NFL broadcaster Tony Romo was arrested for driving under the influence in Milwaukee, and a Hollywood director received 30 months in prison for stealing $11 million from Netflix, cases that underscore how the legal system treats well-known defendants the same as anyone else, at least in theory.

Key questions remain unanswered before September hearing

Several significant gaps remain in the public record. The court documents do not identify the accuser by name, nor do they specify which school or institution she and KJ attend as classmates. The exact Life Time Fitness location has not been publicly identified.

The security camera footage presents an unresolved question. KJ did not scan into the gym that day, yet cameras captured him inside the facility. Neither the court documents as described in reporting nor the defense statements explain how he entered or why no scan was recorded.

The hospital examination's finding of no male DNA is another detail that both sides may seek to use. Prosecutors could argue the one-day gap between the alleged assault and the exam explains the result. The defense may point to it as evidence undercutting the accusations. Neither interpretation has been offered publicly by either side.

For now, a 15-year-old sits in custody without bond, his family insisting on his innocence, his accuser's account preserved in court filings, and a hearing weeks away. The case will test whether the juvenile court system can sort fact from allegation under the full glare of celebrity-driven media attention.

Whatever the outcome, the charges are grave, the accuser deserves a fair hearing, and the accused deserves the presumption of innocence, not trial by headline. The courtroom, not the comment section, is where this belongs.
